We will strive to simplify the Rules and dispose of your complaints
and grievances within a reasonable time.
We will improve efficiency of officers and staff through training,
seminars, workshop. Periodically we will be assessing your suggestion for
improvement of working condition of labourers especially for the children and
women workers.
INDUSTRIAL DISPUTE - STANDARD OF PERFORMANCE
Individual cases of dispute relating to termination, retrenchment can be
raised by individual workman in the format before the respective conciliation
Officer of their zone. The format will be available
with the public Reception Counter headed by the Head Clerk, LC’s
Office.
Collective dispute over the subject matter relating to non-employment
employment, terms and conditions of employment, hours of works etc., can be
raised through registered Unions, group of workmen to which he/she/ they
represent.
The respective Conciliation Officer will, after the receipt of dispute,
investigate and inquire the facts and will also obtain reply on statement of
your claim/dispute within a period of 10 days.
The Conciliation Officer will scrupulously follow the principle of Natural justice, give you and your employer adequate opportunity to represent in the proceedings and finally will persuade to bring a settlement or otherwise submit a report on its failure to the A&N Administration for adjudication or otherwise within two or three sittings from initiating conciliation. In exceptional case on request of any of the parties on genuine ground, the conciliation may take more than two or three sittings. Thus the entire process may take a minimum of about two weeks time and a maximum of about two months.
CLAIM OF
COMPENSATION UNDER WORKMEN'S COMPENSATION ACT
At first send your claim to the employer.
Workmen or dependents of deceased may file a claim before the
Commissioner in person or through post.
We
aim to attend to your genuine claim of compensation within 3 days of its
receipt. If we can’t we will explain the reason personally.
We aim to complete examination of your case within 60 working days
normally and after taking consideration of all records your employer will be
asked to deposit the compensation, it will be distributed and deposited
to the dependents accounts duly pledged in favour of Commissioner for
specific period.
The monthly or quarterly installment will be released to the dependents of
deceased as would be essential for their livelihood.
We aim to settle and pass an order on any disputed matter of claim
of compensation within 60 days from receipt of application.
REGISTRATION AND LICENCES
The Occupier of a factory can apply and obtain registration of the
factory within 30 days from receipt of application of the factory within 30 days
from receipt of application subject to fulfilling condition and remitting fee of
rupees through challan in favour of Chief Inspector of Factories. Forms are
available in the PG Counter of this office.
The Principal employer of an Industrial Establishment employing
more than 20 contract workers may apply to the Registering Officer and obtain
registration by remitting prescribed fees through challan. Forms are available
in the P.G. Counter of this office. The entire process
will involve 2 or 3 weeks time.
Any
seven or more than seven persons can form an union and may apply for
registration to the Registrar of Trade Union through an application available
with the PGO of OG Counter of this office. The entire process beginning from
rectification of by-laws to remitting fees through challan involve minimum
period of 1 month.
The
employer engaging more than 5 workers in any transport undertaking public and
private may obtain registration by remitting fees through challan duly complied
with all requirement. The forms are available with P.G.O of P.G Counter of this
office.
LICENCES
Licences are issued to the contractors, under Contract Labour(R&A)
Act and Interstate Migrant Workmen Act for period of one year and requires
renewed every year. We aim to issue licences within a 30 days time subject to
fulfilling then conditions and requirement as envisaged under the Act and Rules
after being remitted prescribed fees. Application forms are available within the
PG Counter of this office. Detailed information may also be obtained form then
PG Counter.
The
occupier of a factory registered under the Factories Act has to obtain /renew
licence under the Act for each calendar year. The application form together with
original licence (in the case of renewals) and challan receipts should be
submitted before the expiry of the licence period (in the case of renewals). The
entire process may take one to two weeks time.
NON
PAYMENT OF WAGES AND LESS PAYMENT
We
aim to settle your genuine complaint on unpaid wages and less payment through
informal discussion with in 15 days of it s receipt. Failing which a claim application will be filed before the authority by
an Inspector of this Directorate. You may also prefer an alternative forum
envisaged under the Payment of Wages Act and Minimum Wages Act directly by
filing claim application collectively or through representative Union and get
the order passed. Form for releasing the dues wages are available within the
public grievance counter of this office.
